Welcome to the Lothgha application
Please read the following terms and conditions carefully before using the Lothgha website or app. In case of any discrepancy in interpreting any of the terms mentioned below, the Arabic text will be adopted as the primary and sole document for interpretation. By using the Lothgha website or app, you agree to be legally bound by these terms and conditions, which take effect immediately upon your use of the app or website. If you do not agree with the following terms, please close the site or app immediately. Wilada Hulm Consultancy and Research Company, owner of the Lothgha website and application, reserves the right to change the terms and conditions from time to time, and therefore you should periodically review these terms and conditions and privacy policy. We are not obligated to contact you directly or inform you of any changes made to the terms and conditions, and it will be sufficient to note the date of the last update of the terms and conditions as shown below. As part of our commitment, we welcome all your comments by contacting us through 'Technical Support' on any of the policies and conditions we list below. These terms and conditions were updated and written on the fourth day of May 2024 (according to the Gregorian calendar)
Registration Terms
• Any person under 18 years old (according to the Gregorian calendar) who wants to use the Lothgha website or application needs to register through their guardian where they are only allowed to do so by registering within the application as 'a parent with a child suffering from speech problems'. Accordingly, parents or guardians are committed to monitoring their children's activities and are responsible for the actions of their children as long as they have not reached the age of majority, which is 18 years old (according to the Gregorian calendar). If we are informed or discover in our way that the user is under the legal age to create an account with Lothgha, we will temporarily suspend the account until we obtain parental consent, which is done by obtaining the parent's email address through the child's request for a parent's email address, in compliance with the Children's Online Privacy Protection Act requirements in any sites or apps targeting children. If you believe your child is participating in an activity that collects personal information and you have not received an email notification or request for consent, please do not hesitate to contact us via email or technical support via WhatsApp. • By using the Lothgha application, you acknowledge and undertake that you have the right and legal capacity to use the service according to the law of your country, and for guidance without limitation, the minimum legal age to use the service is 18 years for Arab countries, 18 years for China, 16 years for the Netherlands, 14 years for Germany, Australia, South Korea, Spain, and the United States of America, and 13 years for the rest of the world By using the Lothgha app, you agree to refrain from doing or participating in the following matters (whether you do them personally or through a third party) as your use of the Lothgha website or app is at your own responsibility, you agree not to post, upload, send, distribute, store, create or publish in any way, or cause to be published on the Lothgha website and app directly or indirectly through a third-party website any of the following: 1- Engaging in any activity that would affect the operation or security of the Lothgha website and app or cause unreasonable annoyance, abuse, or disruption to any other users or our staff. 2- Transferring your account (including the control panel you manage or the application) to any person without notifying us and obtaining prior written permission allowing it. 3- Engaging in reverse engineering, reverse assembly, or disassembly, or any other activity aimed at discovering the source code or other forms of software processes related to the infrastructure and operations of the Lothgha website or app. Violation of other users' privacy rights or collecting any data and information about other users without their explicit consent, whether manually or using any automated or crawling software (spider) or crawling (crawler) or site search or retrieval application or any other automatic devices or processes to hack the website and/or platform and/or restore index and/or data mining information 5- Providing personal or third-party information, including but not limited to, family name, address, phone numbers, email addresses, credit card numbers 6- Broadcasting viruses, corrupted data, or other files that cause damage, disruptions, or sabotage. Providing content or links to content that we consider, at our sole discretion, to expose us or other users to harm or legal liability in any way 8- Illegal content, or defamation, or slander, or offensive to any religious or moral group, or obscene, pornographic, indecent, or suggestive content, or harassment, or threats, or breach of privacy and publication rights, or violent, or sensitive, or fraudulent or unacceptable in any way 9- Content that constitutes, encourages, or provides instructions for a criminal offense, or violates the rights of any party, or causes in any way legal responsibility or violates any local laws. 10- Content that causes disturbance or harassment to others. 11- Content you do not personally own without express legally recognized permission from the owner of that content. 12- Content that impersonates any real or legal person or causes in any way a false claim of affiliation with that real or legal person, including Lothgha application content. 13- Unwanted promotional materials, political campaigns, advertisements, contests, raffles, or offers. We do not bear responsibility or approve any content published by users, or uploaded in, broadcasted, distributed, stored, created, or published in any way or caused to be published on the Lothgha website and app directly or through a third-party website. We are not responsible for any content posted, stored, or uploaded in groups or interactive pages by you or any third party, nor for any loss or damages resulting from it. We also bear no responsibility for any errors, defamation, libel, slander, omissions, lies, obscenity, pornography, or profanity you may encounter while using interactive pages. We are not responsible for any statements, representations, or content provided by users in any public interactive pages. Users must immediately inform us of such occurrences to take appropriate action at our discretion. In case of complaints arising from the content that a user has posted, uploaded, broadcasted, distributed, saved, created, or caused to be published in any way on the Lothgha website or app directly or through a third-party website, you agree to direct the complaint against that user only and not against us Due to the limited capacity of servers and their use by many people at the same time, you agree not to use the Lothgha website and app in any way that would sabotage or exceed the server's capacity or any network connected to any of our servers, or any action that would impose an unreasonably or disproportionately large load on the infrastructure or bandwidth of the Lothgha website or app.
Specialists
"Those who use the Lothgha website and app as speech therapists, whether they are doctors or speech specialists, and have introduced themselves to us as having sufficient and appropriate training, qualifications, experience, skills, and scientific background in their field of expertise. When using the services of a specialist, you have the option to rate from 1 to 5 and provide any feedback or comments based on your experience with the intended specialist ("feedback")."• The application is shared between the specialist and the applicant where it follows up on receiving the required payments and achieving agreements between the parties, including session appointments, specified date, and session duration. We rely exclusively on the offers provided to us by specialists based on their terms of use, as well as on user feedback. We do not conduct any tests to evaluate these specialists, but we do verify the qualifications, personal information, and academic certificates of the specialists. We urge you to independently verify the background or skills of any expert before receiving any service from them. Please note that none of the specialists work as our agent or representative, or in any way affiliated with us. We do not endorse any of them or show any bias towards them; we merely act as a link between you and the specialists, and we are not, under any circumstances, directly or indirectly involved in any interaction or dealings between any specialist and any third party. We are not responsible for binding or enforcing any agreement that exists between you and the specialist, including any fee agreement. You are solely responsible for any such agreement. In case of disputes between you and any of the specialists regarding transactions carried out through the Lothgha app, you hereby release us and our affiliates, partners, officers, employees, and agents from any claims or lawsuits you may have or related to the specialists or your activities or your abstention from any particular action.
Copyrights
• Please note that the contents of the Lothgha website and application, including but not limited to text, source code, programs, specifications, images, marks, or audio files, are protected by copyright laws and trademarks The specialist must communicate with the requester only within the designated group where the application acts as a mediator. In case of violation, the application has the right to take appropriate action without prior notice. Session Payment The specialist is obligated to protect the user’s information during and after the treatment period. If the requester exceeds the allowed session time, the specialist must inform the requester that the allowed time has been exceeded and may terminate the session unless mutually agreed upon. Session Schedule The remaining time for the session to end is determined as soon as the agreed-upon scheduled time between the applicant and the specialist begins. In case the applicant is late, the specialist may count the remaining minutes and inform them upon entry... unless by mutual consent between the parties. If the applicant agrees with the specialist to contact externally, the app may terminate the contract between the app and the specialist and freeze their balance after verifying the accuracy of the data.
App Commitments
The application is committed to preserving user information and not disclosing it in accordance with the privacy policy. The app has the right to take appropriate actions and measures promptly in case the specialist or applicant violates any agreed-upon terms and conditions. Upon confirming payment and receiving payments from the requester, the application must send the full details to the specialist, including case information, session price, and any other information the specialist may need. If the applicant agrees with the specialist to contact externally, the app may terminate the contract between the app and the specialist and freeze their balance after verifying the accuracy of the data. The application is a mutual party between the specialist and the requester, monitoring the receipt of the required payments and fulfilling agreements between the parties, including session schedules, specified dates, and session duration. If the applicant privately contacts the specialist, the specialist must respectfully prevent them from doing so and ask them to communicate only within the designated group.
Payment, Pricing, and Refund Policy
The applicant is committed to paying for one or several sessions before opening the chat group between them and the specialist. The prices of the provided service differ according to the applicant's location, and the payment is not sent to the specialist until after the applicant evaluates the session. In case of a negative evaluation and poor service performance, the application communicates with the specialist and verifies the data, then the application takes the appropriate action which may include full refund to the applicant or cancellation of the contract with the specialist. The applicant can also replace the chosen specialist at any time, and in case of price differences, they are refunded to the applicant or requested to pay the due amount if a specialist providing the service at a higher price than the specialist chosen at the beginning of the reservation is selected.
Companies Providing the Same Service
Once any specialist joins the Lothgha app team, they are shared with specific goals of the application and the company's full vision. They are involved in improving the user experience and finding solutions with the developers. They may be required to attend administrative meetings with the co-founders. In all previous cases, any information shared with the specialist must not be disclosed to any company providing the same service, nor can they use that information to compete with a private project. If violated, the application has the right to demand compensation and terminate the contract with the specialist, as well as freeze their balance in the application.

We at Lothgha respect all user rights while adhering to the responsibilities stipulated by law, which cannot be excluded. Neither we nor any of our directors, employees, agents, or contractors are liable to you for any losses, damages, liabilities, claims, and costs (including but not limited to legal costs and defense or settlement fees) in any way, whether directly or indirectly, or as a result of, arising from, or in connection with accessing the Lothgha website and app due to your reliance on the information provided through the platform or specialists or third-party content or websites or third-party services, in any way caused, whether in contract, tort (including negligence), law, or otherwise. We are not responsible for any damages caused by any specialists, regardless of whether we or our authorized representative have been informed of the possibility of such loss or damage. Disclaimer
